These Terms govern your use of Lodgey, an AI-powered tax assistant for Australian property investors. By using the platform you agree to these Terms in full. If you do not agree, do not use the service.
When you create a Lodgey account, you are asked to tick two acknowledgements on the signup screen before the account form is enabled:
- Policy & data-processing consent (APP 8). You agree to the Privacy Policy, these Terms, and the Model Spec, including that your data is processed by third-party AI and infrastructure providers, some located overseas. The full list of overseas recipients is set out in Privacy Policy § 06. Australian Privacy Principle 8 requires this disclosure and your express consent.
- General-information acknowledgement. You acknowledge that Lodgey is not a registered tax agent, financial adviser, or credit licensee, that all output is general information only, and that you will verify any tax figures with a TPB-registered agent before acting.
Ticking these boxes records your consent with a timestamp and is the basis on which we grant access to the service. Continued use of the account is an ongoing acceptance of these Terms, the Privacy Policy, and the Model Spec. You may withdraw consent at any time by deleting your account; AI-dependent features cease to function without the data-processing consent.
Lodgey is a beta product under active development.
Features may be experimental, incomplete, or removed without notice. The service may contain bugs, experience downtime, produce incorrect outputs, or behave unexpectedly. You use the service at your own risk, understanding that quality and availability will fluctuate during the beta period.
Lodgey is not a registered tax agent, financial adviser, credit licensee, or legal practitioner under Australian law.
All content, reports, calculations, projections, summaries, and suggestions produced by Lodgey — including those generated by its AI assistant — are general information only. They do not constitute:
- Tax agent services, or “BAS services”, as defined under the Tax Agent Services Act 2009 (Cth)
- Personal or general financial product advice under s 766B of the Corporations Act 2001 (Cth)
- Credit assistance under the National Consumer Credit Protection Act 2009 (Cth)
- Legal advice of any kind
- Advice from a qualified accountant, mortgage broker, or bookkeeper
You must engage a qualified, registered professional before making any financial, tax, or legal decision based on information provided by Lodgey. Lodgey does not lodge tax returns, vary PAYG withholding, or transact with any financial product on your behalf.
Where Lodgey will refuse to answer
Lodgey is instructed to refuse and redirect — not answer — any request that asks it to:
- Recommend whether to buy, sell, subdivide, refinance, or restructure a property or loan
- Advise on superannuation, SMSF contributions or switches, insurance, shares, managed funds, or crypto
- Sign off on a tax position that will be lodged with the ATO
- Guarantee a specific refund, saving, or ATO outcome
In those situations Lodgey will point you to the TPB public register or an AFSL-licensed adviser.
Lodgey uses large language models (LLMs) supplied by third-party AI providers. These models can:
- Hallucinate — produce plausible-sounding but factually incorrect information, including fabricated ATO rules, thresholds, or case references
- Misinterpret uploaded documents or apply incorrect tax rules to your situation
- Contain outdated training data that does not reflect current Australian tax law or ATO guidance
- Make arithmetic or logical errors in calculations and projections
- Omit relevant deductions, obligations, or compliance requirements
You are solely responsible for verifying every output against authoritative sources (ATO rulings, legislation, your registered tax agent) before relying on it.
- You are responsible for the accuracy and completeness of all information you provide to Lodgey.
- You must independently verify all AI-generated outputs before acting on them.
- You must not submit Lodgey outputs to the ATO or any government body as professional tax advice.
- You must keep your own backups of important financial records — Lodgey is not a system of record.
- You must not use the service for unlawful, fraudulent, or abusive purposes.
- You are responsible for your account credentials and all activity under your account.
Lodgey sends your prompts, uploaded documents, and contextual data to third-party AI model providers for processing. These providers operate under their own terms and privacy policies. We also rely on third-party services for hosting, database, authentication, observability, and analytics. The full list of providers is set out in the Privacy Policy and Model Spec.
We are not responsible for third-party outages, data delays, model changes, policy updates, or processing errors by these providers.
- You must provide accurate registration information.
- You must keep your login credentials secure.
- You may request deletion of your data at any time via your account settings, subject to our legal retention obligations.
Paid features may be offered by subscription. Pricing, plan features, and billing terms may change — especially during beta. Continued use after a pricing change takes effect constitutes acceptance of the new terms.
The platform, software, branding, and original content are owned by Lodgey or its licensors. You receive a limited, revocable, non-transferable licence to use the service for its intended purpose. Your uploaded data remains yours.
We may modify, suspend, or discontinue any part of the service at any time without liability. We may pause or disable accounts to address security, legal, or operational risks. During beta, breaking changes may occur without advance notice.
To the maximum extent permitted by law, the service is provided “as is” and “as available.”
We make no warranties — express or implied — regarding fitness for purpose, accuracy, reliability, uninterrupted availability, or error-free operation of the service or its AI outputs. Nothing in these Terms excludes rights that cannot lawfully be excluded, including consumer guarantees under the Australian Consumer Law.
To the maximum extent permitted by law, Lodgey, its founder, and its officers are not liable for:
- Indirect, consequential, special, exemplary, or loss-of-profit damages
- Incorrect tax calculations, missed deductions, or compliance failures resulting from AI-generated outputs
- Penalties, interest, or fines imposed by the ATO or any tax authority arising from reliance on Lodgey outputs
- Data loss, corruption, or unauthorised access
- Business interruption or loss of opportunity
- Decisions made based on AI hallucinations or inaccurate information
Where liability cannot be excluded, our total aggregate liability is limited to the greater of (a) fees paid by you in the 12 months preceding the claim, or (b) AUD $100.
You agree to indemnify and hold harmless Lodgey, its founder, officers, and contractors from any claims, losses, liabilities, and costs (including legal costs on a full indemnity basis) arising from:
- Your misuse of the platform or breach of these Terms
- Your reliance on AI-generated outputs without independent professional verification
- Inaccurate or misleading information you provide to Lodgey
- Tax penalties or financial losses arising from your use of the service
- Your violation of any applicable law
You acknowledge that Lodgey is a software tool and does not provide “tax agent services” as defined under the Tax Agent Services Act 2009 (Cth) (TASA). Lodgey is not registered with the Tax Practitioners Board (TPB). Any tax-related output is informational only and must be reviewed by a TPB-registered tax agent or BAS agent before submission to the ATO.
You further acknowledge that the ATO's administrative-penalty safe-harbour provisions under s 284-75(6) of Schedule 1 to the Taxation Administration Act 1953 (Cth) only apply where a TPB-registered tax agent prepared the statement. Reliance on Lodgey output alone does not qualify for safe harbour.
Lodgey does not hold an Australian Financial Services Licence (AFSL) and does not provide financial product advice within the meaning of s 766B of the Corporations Act 2001 (Cth). Lodgey does not consider your personal objectives, financial situation, or needs when producing information.
Where you ask Lodgey for a recommendation involving a financial product (including superannuation, SMSF, insurance, shares, managed funds, or gearing strategies), Lodgey is instructed to decline and redirect you to an AFSL-licensed adviser. Search the ASIC Financial Advisers Register at moneysmart.gov.au/financial-advisers-register.
Consistent with Australia's Voluntary AI Safety Standard (Department of Industry, Science and Resources, Sep 2024) and the AI Ethics Principles, we:
- Disclose AI use at the point of interaction — the chat identifies Lodgey as AI-powered. Full model details are published in our Model Spec.
- Provide contestability — every AI output can be flagged via the in-app feedback form. Flagged outputs are reviewed by our team.
- Maintain records of AI interactions for a period sufficient to support review, dispute resolution, and regulatory inquiry.
- Do not use your data to train models. Our commercial API agreement prohibits our AI provider from training on API inputs.
- Test and monitor Lodgey for accuracy on a curated set of Australian tax scenarios and publish material changes to its behaviour.
Agentic capabilities
Lodgey can autonomously execute multi-step actions on your behalf, including searching your Gmail for receipts, reading and writing files in Google Drive and Sheets, filing evidence, running calculations in a sandboxed environment, and searching the web for current ATO thresholds. External integrations (Gmail, Drive, Xero) require explicit opt-in per session and are revocable at any time. Destructive actions (deleting evidence, overwriting data) require confirmation via an in-chat prompt before execution. All tool invocations are logged for audit. See our Model Spec for full details.
These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria and, where applicable, the Federal courts of Australia.
We may update these Terms at any time, particularly during beta. Material changes will be noted on this page with an updated date. Continued use after publication constitutes acceptance of the revised Terms.
